The Criminal Justice Act (“CJA”) provides for the appointment of counsel in criminal cases to persons who are financially unable to obtain adequate representation. 18 U.S.C. § 3006A(a). In the Southern District of Texas, in cases where the Federal Public Defender has not been appointed to represent a defendant who is entitled to the assistance of appointed counsel, individual defense attorneys are chosen from a federal panel. The Federal Public Defender is charged with assuring that members of the CJA panel are familiar with federal criminal practice.

 

A defendant has the fundamental constitutional right to testify in his criminal trial. The right to testify is an inherent part of the Due Process Clause of the Fourteenth Amendment and the Compulsory Process Clause of the Sixth Amendment. In an effort to safeguard a Defendant’s fundamental rights, we are presenting a CLE that will discuss the pros and cons of a client testifying on his behalf as well as provide useful tips and strategies in preparation for the client’s testimony. The Criminal Justice Act (“CJA”) provides for the appointment of counsel for criminal charges as part of its commitment to indigent defense. Through this CLE you will develop (or refresh) a skillset to effectively conduct direct-examination on your client’s behalf whether at trial or another adversarial hearing.
