The United States Sentencing Commission has decided to allow retroactive application of the November, 2007 reductions for crack sentences, effective March 3, 2008. Previously sentenced defendants may file a motion for reduction pursuant to 18 USC 3582(c). These reductions are up to the discretion of the sentencing court and will be limited to the potential new two-level reduction. For further guidance, see the revised USSG 1B1.10.
